Europe is in a #CostOfLivingCrisis. So, Member States should rapidly enact the #MinimumWagesEU Directive!

Any Member State is free to go to the #CJEU, but it should not lead to a delay of the implementation.

People simply cannot afford to wait!

The study identified 27 steps, with regard to the Constitutional Court and the ordinary judiciary, that gravely violate one or multiple European standards and principles regarding judicial independence recognized by the CJEU and the ECtHR.

The Hungarian government has taken numerous steps to dismantle judicial independence, from court packing, forced retirement and limiting court competences, to changing court structures, retributions, disciplinary proceedings and creating a climate of fear.

Indeed, but political responsibility cannot be outsourced to the #CJEU. The @Europarl_EN has a duty to hold @EU_Commission to account. So far it has largely failed to do so.

Judiciary in Poland is not independent. Approving the Polish recovery plan in the Council was a mistake. A mistake with consequences for hundreds of judges and millions of EU citizens.

Holding EU member states' governments legally accountable is the right step!

The best way of getting the funds disbursed is by meeting the criteria and restoring the independent judiciary. It is not that complicated.

The #CJEU ruling essentially says that the implementation of the #PNRdirective should meet certain standards, rather than the directive itself. But the presumption of compliance could easily become the pretence of compliance.

The only credible way out is
👉🏼 Immediate and FULL reinstatement of all judges fired, suspended, transferred etc.
👉🏼 Full compliance by 🇵🇱 with ALL #CJEU and #ECHR rulings
👉🏼 And acceptance of primacy of 🇪🇺 law

No money without full restoration of the Rule of Law. 7/7

I’m not a legal expert, but if suspending or otherwise disciplining judges is unlawful - clearly ruled by #CJEU - should they in principle not be able to take up their job and fully function as if the illegal disciplinary chamber never existed? No fake ‘milestone’ needed. 5/x

The @ALDEParty #aldepartycongress just voted: in case the @EU_Commission makes any payments to PL before all #CJEU rulings have been implemented @reneweuropegroup should withdraw its confidence from the Commission and table a motion of censure.

In an op-ed in today’s Gazeta Wyborcza I claim that a new statute pretending to eliminate the Disciplinary Chamber in PL is a big lie. European Commission should not use it as a reason to dispense recovery funds to PL. At stake is the fate of independent judges.

The @EuropeanCommission must reject bribery.

The EP committee on budgetary control has again postponed the discharge of the Frontex budget, because of concerning findings by OLAF and its assistance of the Hungarian government, which is condemned by the CJEU for breaching EU asylum and return law.

Irony: Polish government has challenged Rule of Law conditionality for the EU budget (no ⚖️= no 💶) before the CJEU, but that same Polish government does not recognise the authority of the CJEU. So no need for @vonderleyen to wait for CJEU ruling then to apply RoL conditionality

Data retention and mass surveillance are the pet obsession of national governments since many years. So many sneaky attempts in the Council to circumvent #CJEU rulings. But so far no shred of evidence for its necessity or proportionality. @Europarl_EN has to be vigilant.

Maybe the point is that the #CJEU has already repeatedly ruled that Council Conclusions have no binding effect. Basically they can ramble all they like. The problem here is that the @EU_Commission is following instructions by the Council, violating the requirement of independence

Key question: would @EU_Commission have the guts to refuse issuing and Adequacy Decision on UK, even if conditions aren’t met? Pressure by US will be huge and EC traditionally prefers to pick a fight with the #CJEU rather than antagonise the 🇺🇸

@grimmse Not about St Margrethe or judicial supremacy. I too have a law degree (of sorts) and I was trained to think about what law means for citizens. I am concerned about inertia over multinational tax planning and I didn't see any bright ideas from the court today on this urgent issue.

+1In 2017 @EUCourtPress judged 🇪🇺🇨🇦 #PNR agreement incompatible with EU fundamental rights. #EUPNR Directive and EU-🇺🇸&🇦🇺 PNR agreements are equally contrary to Charter of Fundamental Rights. But @EU_Commission has been ignoring the #CJEU 🙉🙈🙊 & failed to act. Read my questions⤵️

+2National governments can shelve their Big Brother plans for now. Blanket data retention is NOT allowed under EU law says #CJEU Advocate General. Only targeted, temporary and in cases of imminent danger. And only with all safeguards proper for a democractic society. @EUCourtPress
