Ministerie moet van ⁦@toezicht_AP⁩ per direct stoppen met verzamelen gegevens luchtvaartpassagiers #PNR. Goed dat de excessieve datahonger wordt ingeperkt. Maar je zou toch hopen dat de overheid zich spontaan aan de wet houdt @nrc⁩ nrc.nl/nieuws/2023/02…

+1Even if #CJEU did not scrap the #PNR Directive alltogether, @EU_EDPB makes clear that the current national laws and practices for the processing of #PNR data are not in line with the #CJEU interpretation. Yet @EU_Commission and member states are in no hurry to fix it 1/2

Important ruling of the ECJ on #PNR: There is homework for Member States with regard to the processing of data from Intra-EU flights, but #PNR directive is valid, and consistent with the Charter!

Op 9 dec komt @EUCourtPress met voorlopige uitspraak of #PNR richtlijn in strijd is met fundamentele rechten⚖️

Typical @EU_Commission approach: political considerations prevail over legal criteria. This Adequacy Decision may well end up in the bin, next to the Data Retention Directive, Safe Harbor, Privacy Shield, PNR.

Current security policies and agreements must always be fully in line with @EUCourtPress case law. @EU_Commission is refusing to do that mostly, like in the #PNR agreements with 🇺🇸&🇦🇺. Parliament considers this a great omission/4

I am highly sceptical. Not least as @EU_Commission has quite a track record of ignoring criticism and doubts expressed by experts, and betting on the wrong horse...(data retention directive, Safe Harbour, Privacy Shield, PNR)

The @EUCourtPress has already slammed an EU-Canada agreement on the transfer of #PNR. The agreement with the US should have been terminated as well. But to date the @EU_Commission has refused to do so. It gives precedence to friendly transatlantic relations over defending EU laws

Why does @EU_Commission consider a 99.7% false hit rate in the German #PNR system to be normal & acceptable?

It is a major breach to citizens’ privacy and disproportionate burden on law enforcement.

Once again the #CJEU exposes the legal holes in security policies. @EU_Commission does not seem to learn any lessons (data retention, Safe Harbour, PNR, etc), and keeps churning out legally unsound proposals. At the expense of fundamental rights and the rule of law.

+1Do you think it is a good idea to share personal data with Saudi Arabia? I don't. The @EU_Commission should refuse to negotiate data sharing deals with such countries. Seems rather illusory to rely on Saudi data protection assurances🙄 #PNR

@Johannaboogerd @EuroPaulB Het Europees Parlement heeft de ongerichte, grootschalige opslag van #PNR passagiersgegevens al voorgelegd aan het EU Hof van Justitie. Het oordeel was glashelder: mag niet. Ook NLse Raad van State wijst wet in de huidige vorm af.
